CHRISTMAS V NABORS IS ONGOING

Where legal mail is scanned and then delivered, it may violate the first amendment rights of the incarcerated individual. Plaintiff Christmas sued his jail and jail Commander, the 11th Circuit Court of Appeals agreed that his claims amounted to a violation of his constitutional rights. His case is now proceeding against the jail Commander and Sergeant in their individual capacities.

LEGAL MAIL UNDER ATTACK IN OHIO

Photocopying legal mail and keeping original may violate first amendment. A filing in Ohio claims that where jail officials photocopy paper mail in front of an incarcerated individual and provide them with a copy while retaining the original, the possibility that a jail may read the mail violates attorney-client privilege.
